Acceptance of Terms
By accessing or using the Curbly website, applications, account features, or services (the “Service”), you agree to be bound by these Terms of Service.
If you do not agree to these Terms, please do not use Curbly.
These Terms may apply to:
- Homeowners
- Residents
- Customers
- Property managers
- HOA representatives
- Operators and service personnel
- Visitors
- Other users of the Curbly platform
Service-specific terms may also be governed by a separate Service Agreement presented during enrollment. These Terms govern general use of Curbly’s website, apps, accounts, and platform; a Service Agreement will govern property-specific paid service once a customer enrolls.
About Curbly
Curbly is a residential trash-bin valet service. Depending on your setup and coverage area, Curbly may:
- Move residential bins to the curb
- Return bins after municipal collection
- Provide photo confirmation of service
- Support property and service setup
- Help coordinate recurring service
We move bins. We don’t collect trash.
Curbly helps with bin placement and return. Municipal trash, recycling, and waste collection are performed by the customer’s local waste provider, not Curbly.
Curbly is not a waste hauler, does not transport or dispose of trash or recyclables, and does not control municipal collection schedules.
Account Registration
Some features require a Curbly account. If you create one, you agree to:
- Provide accurate information
- Keep your information current
- Maintain the security of your account
- Keep login credentials confidential
- Notify Curbly of suspected unauthorized access
- Be responsible for activity under your account, where legally permitted
Eligibility
You must be legally able to enter into an agreement and to use Curbly in accordance with applicable law.
You may not use Curbly if doing so would violate any law that applies to you.
Customer Responsibilities
Customers are responsible for:
- Providing an accurate service address
- Providing the correct collection day
- Entering accurate bin count and bin type information
- Keeping property and access instructions current
- Providing a safe, exterior-accessible bin location
- Ensuring bins are available when service is scheduled
- Notifying Curbly of schedule or property changes
- Ensuring service does not violate HOA or property rules
- Keeping pets and hazards away from the service path where reasonably necessary
Customers should not:
- Request unsafe access
- Require entry into prohibited areas
- Intentionally provide misleading property information
- Interfere with Curbly operators
- Use Curbly for unlawful purposes
Property Access & Instructions
Curbly currently services exterior-accessible bin locations. To support service, customers may provide:
- Bin storage location
- Gate or access instructions
- Exterior gate details
- Reference photos
- Special service notes
- An approved exterior handoff location
Curbly operators should not be required to enter homes, attached garages, interior rooms, or private living areas.
If bins are stored in a garage, the customer must make them available at an approved exterior handoff location before scheduled service — for example a driveway, the side of the house, behind an exterior gate, or another agreed exterior-accessible area.
Curbly may decline or pause service if:
- Access is unsafe
- Access instructions are inaccurate
- Bins are inaccessible
- An animal creates a safety concern
- Access would require prohibited interior entry
Our Service
A typical service visit follows this lifecycle:
- Bin set-out before collection
- Municipal collection occurs
- Bin return after collection
- Service confirmation may be recorded
Exact timing may vary. Route timing can depend on neighborhood conditions, and municipal collection timing is outside Curbly’s control. Service is generally scheduled around your local collection day rather than a guaranteed minute.
Service Limitations
Curbly may not be able to provide service when:
- Bins are inaccessible
- Gates are locked
- Access instructions are incorrect
- Dangerous weather conditions exist
- Unsafe property conditions exist
- Municipal collection has not occurred
- The property cannot be safely accessed
- The number or type of bins materially differs from the account setup
- The property is outside an active coverage area
Curbly may reschedule, delay, skip, pause, or cancel a service when reasonably necessary for safety, access, operational, or legal reasons.
Photos & Service Verification
Curbly may use photos to:
- Confirm bin location
- Verify bin placement
- Verify bin return
- Document service issues
- Resolve support concerns
- Confirm property setup
Service photos are intended to focus on bins, exterior service areas, and relevant access conditions. Operators should avoid intentionally photographing residents, children, interiors, or unrelated private activity unless needed to document a legitimate issue.
Handling of personal information, including photos, is described in our Privacy Policy.
Payments
Payment functionality is not currently active in the pre-launch experience. Curbly does not collect payment information or process charges through the current account preview.
When paid service launches:
- Customers may be required to provide a valid payment method
- Fees will be disclosed before purchase
- Recurring subscription terms will be shown before activation
- Payment processing may be handled by a third-party provider
Payment-specific terms may be updated when billing goes live.
Cancellations & Changes
Customers may request changes or cancellation subject to Curbly’s then-current Cancellation Policy and applicable service terms.
A dedicated Cancellation Policy will be published before paid service begins. Until then, contact Curbly with any questions about changing or ending a future service plan.
User Conduct
When using Curbly, you may not:
- Misuse the website or app
- Interfere with service operations
- Impersonate another person
- Harass operators or staff
- Submit fraudulent claims
- Provide knowingly false service information
- Attempt to access accounts or systems without authorization
- Damage, probe, scrape, reverse-engineer, or abuse platform systems where prohibited
- Use Curbly for illegal activity
Operators & Service Personnel
Curbly may use authorized operators or service personnel to perform service. An operator receives only the information reasonably necessary for the assigned service, which may include:
- Property address
- Bin location
- Bin count and bin types
- Exterior access instructions
- Service notes
- Reference photos
- Route instructions
Intellectual Property
Curbly owns or licenses the materials that make up the Service, including:
- Website content
- App design
- Logos
- Branding
- Trademarks
- Text and graphics
- Software and interfaces
- Proprietary technology
You may not copy, reproduce, distribute, or commercially exploit Curbly materials except as allowed by law or with written permission. Content you provide remains yours.
Third-Party Services
Curbly may integrate with third parties for functions such as:
- Maps and navigation
- Hosting
- Authentication
- Analytics
- Communications
- Payments in the future
- Other operational tools
Third-party services may have separate terms and privacy policies, and Curbly does not control all third-party systems.
Disclaimers
Curbly is provided subject to availability. Curbly does not control:
- Municipal waste collection
- City schedules
- Public roads
- Severe weather
- Utility outages
- HOA decisions
- Third-party provider availability
We work to provide reliable, consistent service, but factors outside our control can affect a scheduled visit.
Limitation of Liability
To the maximum extent permitted by applicable law, Curbly’s liability may be limited for indirect, incidental, special, consequential, or similar damages arising from use of the Service. Nothing in these Terms limits rights that cannot be limited under applicable law.
Indemnification
To the extent permitted by law, you may be responsible for losses or claims resulting from:
- Unlawful use of Curbly
- Violation of these Terms
- Knowingly false information
- Unauthorized property-access instructions
- Misconduct causing harm
Dispute Resolution
If a dispute arises, we encourage you to contact Curbly first so we can try to resolve the matter informally and in good faith. Most questions and service concerns are resolved this way.
Changes to These Terms
Curbly may update these Terms as the service evolves.
When material changes occur, we update the Last updated date at the top of this page and provide additional notice where appropriate or required. Continued use after an effective update may constitute acceptance where permitted by law.
Governing Law
Curbly operates from Nevada. These Terms are intended to be governed by applicable Nevada law, except where another law applies or controls.
