Overview
This Service Agreement applies when you enroll a specific property in Curbly’s residential trash-bin valet service (“Curbly Valet”). It explains:
- The service Curbly intends to provide
- The property details used to provide that service
- Your responsibilities as a customer
- Service limitations
- Payment and cancellation terms once billing is live
- How this Agreement works with Curbly’s other legal policies
A simple partnership.
You provide accurate property details and safe access. Curbly handles the bin movement. Together, we keep trash day simpler.
Your Curbly Service
Curbly provides residential trash-bin valet service. Depending on your setup, typical service may include:
- Moving eligible bins from the approved exterior storage location to the curb
- Returning bins after municipal collection
- Recording service completion
- Providing photo confirmation where available
- Recording service issues when necessary
We move bins. We don’t collect trash.
Curbly does not collect, transport, haul, or dispose of municipal trash, recycling, or yard waste. Collection is performed by your local waste provider.
Curbly does not control municipal collection timing, routes, or schedules.
Property Information
You agree to provide accurate and complete property information, including where applicable:
- Service address
- ZIP code
- Collection day
- Number of bins
- Bin types
- Approved exterior storage location
- Exterior access information
- Property notes
- Reference photographs
- Special service instructions
You agree to keep these details current. If property information is materially inaccurate, service may be delayed, skipped, modified, or require changes to your account.
Access & Service Instructions
Curbly currently services exterior-accessible bin locations only. You may provide:
- Exterior gate instructions
- Gate codes where appropriate
- An approved pickup location
- Side-of-house instructions
- Driveway instructions
- Exterior reference photos
- Special notes
Operators should not be required to enter homes, attached garages, interior living areas, or enclosed private interior spaces.
If your bins are stored in a garage
If bins are normally stored inside a garage, you must place them at an approved exterior handoff location before your scheduled Curbly service. Examples include the driveway, the side of the house, an area behind an exterior-accessible gate, or another approved exterior location.
If bins are not accessible at the approved exterior location, service may be unable to proceed.
Bin Setup & Collection Day
You provide your collection day, bin count, bin types, and other service setup details when enrolling, and you are responsible for notifying Curbly when any of these change.
Service configuration and pricing may depend on the number and type of physical bins associated with your property. Adding or removing bins may change your service setup or, once billing is live, your price.
Curbly Responsibilities
Curbly agrees to use commercially reasonable efforts to:
- Perform scheduled bin-valet service
- Follow saved service instructions
- Use reasonable care while moving bins
- Record service completion
- Document relevant service issues
- Communicate important service information
- Protect customer data in accordance with the Privacy Policy
- Provide support through available support channels
Curbly does not promise that every scheduled service will occur at a specific time or without interruption. Conditions outside Curbly’s reasonable control may affect service.
Customer Responsibilities
You agree to:
- Provide accurate property details
- Make bins accessible at the approved exterior location
- Provide accurate exterior access instructions
- Keep the service path reasonably clear
- Ensure pets or hazards do not interfere with safe access
- Notify Curbly of collection-day changes
- Notify Curbly of bin-count changes
- Keep gate and access information updated
- Ensure requested service complies with applicable property or HOA rules
- Avoid unsafe or unlawful requests
Please don’t
- Require interior entry
- Provide false access information
- Harass or interfere with operators
- Intentionally create unsafe conditions
- Use Curbly for unlawful purposes
Photos & Service Verification
Photos may be used to:
- Confirm bin storage location
- Confirm bin placement
- Confirm bin return
- Document service issues
- Assist support investigations
Service photos should focus on bins, relevant exterior property areas, and service conditions. Operators are expected to avoid intentionally photographing people, children, home interiors, or unrelated private activity unless reasonably necessary to document a legitimate service issue.
Service Availability
Service availability depends on factors including:
- Active coverage area
- Safe access
- Accurate property setup
- Operator availability
- Route capacity
- Weather
- Road conditions
- Municipal collection timing
- Other operational constraints
Curbly may adjust service timing or availability when reasonably necessary. Curbly does not guarantee an exact arrival time or uninterrupted service under all conditions.
Missed or Incomplete Service
A service issue may include situations such as:
- Bins were not moved as expected
- Bins were not returned
- Service could not be completed
- Access prevented completion
- Municipal collection did not occur
- Property information was inaccurate
You can report a service issue through the Support area of your account, or through the Contact page when appropriate. Curbly may review timestamps, operator notes, service photos, and your property setup information.
Possible resolutions
Depending on the circumstances, resolutions may include corrective service, a service credit, a refund review, an account update, or another reasonable resolution. Curbly cannot guarantee a specific remedy for every issue.
Damage & Limitations
Curbly operators are expected to use reasonable care while moving bins.
If you believe property or bin damage occurred during service, please report it promptly through Support or the Contact page so it can be reviewed while records are still available.
Curbly may review photos, operator notes, service records, and property conditions as part of that review. Reporting an issue does not automatically result in reimbursement, and outcomes depend on the facts of each situation.
Normal wear to bins, pre-existing conditions, and damage resulting from unsafe or inaccurate access instructions may not be attributable to Curbly.
Pricing & Billing
Billing is not live yet.
Curbly is currently in pre-launch, and paid subscription billing is not active in the preview experience. No recurring subscription charges are being processed today.
When paid billing launches:
- Pricing will be shown before service activation
- Recurring billing terms will be disclosed
- You must approve the plan before any charge
- Payment may be processed through a third-party payment provider
Your service configuration, including bin count, may affect your price.
Cancellations
Standard residential service is intended to be month-to-month without a long-term commitment.
Cancellation timing, future billing, refunds, and already-scheduled service are governed by Curbly’s Cancellation Policy.
Changes to Service
You may need to update your service setup if:
- Your collection day changes
- Your property changes
- Your bin count changes
- Your storage location changes
- Gate or access information changes
- You move
- Curbly’s service area changes
Curbly may also update service rules or operational procedures as the product evolves. Material changes will be communicated when appropriate.
HOA & Property Manager Arrangements
Some Curbly service may be arranged through HOAs, property managers, community organizations, or master-planned communities. Those arrangements may include:
- Community-wide service rules
- Custom pricing
- Specific service schedules
- Custom access arrangements
- Separate written agreements
Where a separate written community agreement conflicts with this standard residential Service Agreement, the applicable custom or signed agreement may control for that service, where legally permitted. Community arrangements do not, by themselves, waive a resident’s privacy rights.
Term & Termination
This Service Agreement begins when you accept it and activate eligible Curbly service, and it remains applicable while your service relationship is active.
Service may end due to:
- Customer cancellation
- Curbly-initiated cancellation
- Nonpayment once billing is live
- Unsafe access conditions
- Service-area changes
- Repeated policy violations
- Fraud or abuse
- Legal requirements
- Other legitimate operational reasons
After service ends, certain obligations may continue where appropriate, such as those relating to outstanding charges, open disputes, privacy, and applicable legal terms.
Relationship to Terms of Service
This Service Agreement works together with Curbly’s Terms of Service. The Terms of Service govern use of Curbly’s website, apps, accounts, and platform. This Agreement governs property-specific service.
If there is a direct conflict, a properly executed service-specific agreement may control for that specific service issue where legally permitted.
Privacy
Curbly’s handling of account information, property information, access instructions, photos, app and device data, and communications is governed by the Privacy Policy.
Updates to This Agreement
Curbly may update this Service Agreement as service functionality evolves.
When material changes are made, Curbly will update the last-updated date and provide additional notice when appropriate or required.
For active paid customers, material changes affecting service obligations are not intended to apply retroactively in an unreasonable manner.
Governing Law
This Agreement is intended to be governed by applicable Nevada law, except where another law applies or controls.
